1. ACCEPTANCE OF TERMS

Welcome to Nostavia Health (“Nostavia,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Nostavia Health website, mobile applications, digital platforms, and all related services (collectively, the “Services”).

By accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of the Services immediately.

2. ELIGIBILITY

You must be at least 18 years old to use the Services independently.
Users under 18 may access the Services only with the explicit consent and supervision of a parent or legal guardian.
You represent and warrant that all information you provide is accurate, complete, and current. Failure to do so may result in suspension or termination of your account.

3. DESCRIPTION OF SERVICES

Nostavia Health provides digital-first health and wellness services, including but not limited to:

Digital Clinics: Telehealth consultations with certified and/or registered practitioners across disciplines such as general health, fitness, nutrition, mental wellbeing, and integrative practices.
Hyper-Personalized Health Plans: AI-generated, doctor-verified protocols tailored to individual biology, biomarkers, and goals.
Personalized Programs: Structured multi-week or multi-phase programs designed to address chronic health challenges and promote sustainable lifestyle change.
Marketplace: Access to curated wellness products, supplements, and tools offered by third-party vendors.

Nostavia reserves the right to modify, suspend, replace, or discontinue any part of the Services at its sole discretion, with or without prior notice, and without liability or obligation to provide compensation.

4. ACCOUNT CREATION & RESPONSIBILITIES

You are responsible for maintaining the confidentiality of your account credentials.
You are fully responsible for all activities conducted through your account.
You agree to notify Nostavia immediately of any unauthorized use or security breach.

5. DATA PRIVACY & SECURITY

Your privacy is governed by our Privacy Policy, which forms an integral part of these Terms. Data is collected, processed, and protected in accordance with:

The Information Technology Act, 2000
The Digital Personal Data Protection Act, 2023 (and applicable rules)

Key principles include:

Secure encryption and industry-standard safeguards
Limited data sharing strictly for service delivery or legal compliance
No commercial sale of personal or health data

6. TELEMEDICINE & HEALTH DISCLAIMERS

Nostavia complies with the Telemedicine Practice Guidelines issued by the Ministry of Health and Family Welfare and relevant authorities.
Teleconsultations are provided only by qualified practitioners where applicable.
Your explicit consent is required before any telehealth consultation.
Information provided through the Services is not a substitute for in-person medical care, emergency services, diagnosis, or treatment.

If you are experiencing a medical emergency, you must seek immediate in-person medical attention.

7. MARKETPLACE TERMS

Nostavia acts solely as a technology facilitator connecting users with third-party vendors.
Nostavia does not manufacture, sell, inspect, or guarantee marketplace products.
All product-related claims, warranties, fulfillment, and liabilities rest solely with the respective vendors.
You are responsible for reviewing vendor-specific terms, return policies, and usage instructions prior to purchase.

8. PAYMENTS, TAXES & REFUNDS

Payments must be made using approved payment methods available on the platform (e.g., UPI, credit/debit cards, net banking).
All fees are subject to applicable Indian taxes, which may be added at checkout.
Refund eligibility, timelines, and conditions are governed by Nostavia’s Refund Policy.

9. USER CONDUCT

You agree not to:

Upload or transmit unlawful, harmful, abusive, or misleading content
Impersonate any individual or entity
Misuse health information or attempt to manipulate system outputs
Interfere with platform security, functionality, or data integrity
Use the Services for any illegal or unauthorized purpose

Violation of these Terms may result in immediate suspension or termination of your account.

10. INTELLECTUAL PROPERTY

All platform content, software, algorithms, branding, designs, and materials are the exclusive property of Nostavia Health or its licensors.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes only.
Unauthorized reproduction, modification, or distribution is strictly prohibited.

11. USER-GENERATED CONTENT

You retain ownership of any content or data you upload (e.g., lab reports, images, meal photos).
By uploading content, you grant Nostavia a license to store, process, analyze, and use such content solely to provide and improve the Services.

12. DISCLAIMER OF WARRANTIES

The Services are provided on an “AS IS” and “AS AVAILABLE” basis. Nostavia makes no warranties, express or implied, regarding accuracy, completeness, reliability, or suitability of the Services.

Health insights, predictions, and recommendations are informational and supportive in nature, not guarantees of outcomes.

13. LIMITATION OF LIABILITY

To the maximum extent permitted under Indian law, Nostavia shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of data, profits, or business opportunities
Service interruptions or technical failures
Decisions made based on information provided through the Services
Third-party products or services

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Nostavia Health, its directors, employees, and partners from any claims, losses, or damages arising out of:

Your use or misuse of the Services
Violation of these Terms
Violation of applicable laws or third-party rights

15. TERMINATION

Nostavia reserves the right to suspend or terminate your account, with or without notice, if you violate these Terms or engage in conduct that harms the platform, users, or company interests.

16. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of India.
Any dispute shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996.
Arbitration shall be conducted in English and seated in Lucknow, Uttar Pradesh, India.
Courts at Lucknow shall have exclusive jurisdiction where arbitration is not applicable.

17. CHANGES TO TERMS

We may update these Terms from time to time. Updates will be reflected by revising the “Last Updated” date. Continued use of the Services constitutes acceptance of the revised Terms.
